1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Matthias Weber, operating the community initiatives IT'S THE GLUE and 040x040("we," "us," or "our"), concerning your access to and use of our community platforms, website (itstheglue.com), and participation in any related events (collectively, the "Services").

Our Services are provided solely for non-commercial, community-building purposes and operate on a non-profit basis.

By accessing or using the Services, you agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF SERVICE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.

2. Community Nature and Purpose

  • Non-Profit Status: IT'S THE GLUE / 040x040 is a community initiative and is not-for-profit. Any fees associated with events (if applicable) are intended solely to cover organizational costs (e.g., location rental, catering).
  • Purpose: The Services are dedicated to fostering a supportive community for networking, knowledge sharing, and organizing non-commercial social events.
  • No Commercial Expectation: Participation in our events or use of our platforms does not create any commercial partnership, employment relationship, or profit expectation.

3. User Commitments and Conduct

By using the Services, you agree to:

  • Compliance: Abide by all applicable local, state, national, and international laws.
  • Respectful Conduct: Treat all other participants, organizers, and event staff with respect and professionalism. Harassment, discrimination, or abusive behavior of any kind is strictly prohibited and grounds for immediate removal from the community and future events.
  • Code of Conduct: Adhere to any specific Community Code of Conduct published for our events or platforms.
  • Accuracy: Ensure any personal information you provide is true, accurate, current, and complete.

4. Events and Liability

  • Participation at Own Risk: Participation in any physical event organized by IT'S THE GLUE / 040x040 is entirely at your own risk. We are not responsible for any personal injury, loss, or damage to property that occurs during an event.
  • Event Changes: We reserve the right to modify, postpone, or cancel any event at any time without liability, though we will provide reasonable notice where possible.
  • No Guarantees: We make no guarantee regarding the outcome, success, or quality of networking or information received at any event.

5. Intellectual Property Rights

  • Our Content: Unless otherwise indicated, the Services and all source code, databases, functionality, website designs, audio, video, text, photographs, and graphics ("Content") are owned or controlled by us and are protected by copyright and trademark laws.
  • Event Content: By participating in events, you acknowledge that organizers may take photographs, video recordings, or audio recordings for promotional purposes (e.g., website, social media). If you do not wish to be included, it is your responsibility to inform the organizers at the start of the event.

6. Disclaimers

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF.

WE WILL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR PARTICIPATION IN THE SERVICES OR IN ANY EVENT, EXCEPT IN CASES OF INTENT OR GROSS NEGLIGENCE.

7. Governing Law

These Terms and your use of the Services are governed by and construed in accordance with the laws of the Federal Republic of Germany, applicable to agreements made and to be entirely performed within the Federal Republic of Germany, without regard to its conflict of law principles.
